The rules for using the Dema IQ website and screening service, written to keep responsibilities clear.

About these terms

These terms govern use of the Dema IQ website and, where access has been provisioned, the Dema IQ screening service. By using either, you agree to these terms.

Client organisations may also have a signed service agreement, order or other written arrangement with Dema IQ. If that document conflicts with these terms, the signed document governs the service supplied to that organisation.

Access and accounts

Dema IQ is an invitation-only service for approved institutions. You may use an account only if your organisation has authorised you and your role permits the action you are taking.

  • Provide accurate account information and keep it current.
  • Do not share one-time codes, session access or another person's account.
  • Tell your organisation administrator promptly if you believe access has been lost, misused or compromised.
  • Your organisation is responsible for deciding who may use the service on its behalf.

What the service provides

Dema IQ compares submitted identity information with the screening lists enabled for a client organisation. A result records the list, dataset version, search time, submitted identity, comparison method and the evidence returned for that search.

Results may be described as Match, Possible match or Nothing found. A result or certificate is not an FIC clearance, legal opinion, regulatory approval or guarantee about a person. Your organisation remains responsible for confirming identity, conducting any further due diligence and making its own risk decision.

Acceptable use

Use the service only for lawful screening, compliance and risk management purposes for which you and your organisation have proper authority. You must not:

  • submit information you are not authorised to process;
  • attempt to access another organisation's records or accounts;
  • scrape, bulk extract, resell or reconstruct Dema IQ's register, source library or matching methods;
  • interfere with security controls, probe the service for vulnerabilities or introduce malicious code; or
  • use a result to misrepresent clearance or regulatory approval.

Information and confidentiality

Your organisation keeps its rights in information it submits. It gives Dema IQ permission to process that information to operate, secure and support the service, produce requested results and meet applicable record-keeping obligations.

Dema IQ's software, register structure, source library, matching methods, interface and supporting materials remain Dema IQ property. A client may use issued results and certificates for its internal compliance work and legitimate disclosures, but may not redistribute the underlying service or source library.

Availability and changing information

Dema IQ works to keep the service available and its records reviewable, but does not promise uninterrupted or error-free access. Maintenance, security events, provider outages or unavailable source material may delay a search or make one list temporarily unavailable.

Official lists and public records change. A result describes the specific search recorded on it; it does not predict what a later search will return. Material service changes will be communicated to affected client organisations where reasonably practicable.

Fees and client arrangements

Access, enabled screening lists, usage allowances, support and fees are agreed with each client organisation. Those commercial terms appear in the applicable service agreement or order, not on this page.

Suspension and termination

Dema IQ may restrict or suspend access where reasonably necessary to protect the service, investigate misuse, comply with law or respond to a breach of these terms. Where circumstances allow, the affected organisation will be told what happened and what is required to restore access.

Ending access does not erase records that must be retained under an agreement, a legal hold, applicable law or the retention schedule described in the Privacy Policy.

Responsibility and liability

Nothing in these terms excludes a responsibility or remedy that cannot lawfully be excluded. Subject to that limit and any signed client agreement, Dema IQ is not responsible for a decision made by a client organisation, for information the client submitted incorrectly, or for a change to an external list after the recorded search time.

Each party remains responsible for losses caused by its own unlawful conduct, fraud, wilful misconduct or breach of confidentiality.

Changes, governing law and contact

Dema IQ may update these terms when the service or applicable requirements change. The date above shows the latest revision. Changes apply prospectively; material changes affecting a client service will be communicated through the organisation's established contact where reasonably practicable.

These terms are governed by the laws of Namibia. Client organisations should use the contact details in their service agreement for legal or contractual notices. If you do not yet have a service agreement, you can contact Dema IQ through the demo request form.
